Solidarity or legal battle for the payment of the rent by shops which have been forced to close ?



The closure requirement for most shops has put tenants backs to the wall. Some are invoking ‘force majeure’ in order to be able to no longer pay their rent. Owners refer to the clauses of the lease contract. Are we moving towards relative solidarity in the face of this unprecedented situation or a standoff?
Interviewed by Philippe Coulée, Francoise Blaise, lawyer at Heilporn & Kadaner, analyzes the legal situation resulting from the ministerial decree of March 23, which aims to limit the spread of the coronavirus, in particular by stopping any ‘non-essential’ commercial activity. According to the law: ‘A lessor cannot demand that a tenant carries out operations in the property, when a government provision prohibits him from doing so.’ Francoise Blaise is thus calling for more solidarity than for a legal battle.
